By using our website, booking an appointment, purchasing a product, or otherwise engaging with our services, you confirm that:

2. Description of Services

Balanced Beauty Med Spa is a professional medical aesthetics practice providing the following categories of services in Vaughan, Ontario:

• Medical and custom facials (including HydroFacial, chemical-based facials, specialty facials)
• Chemical peels (including Perfect Derma Peel, Green Peel, TCA, Glycolic, Mandelic, Salicylic, Jessners, and GlyMed AHA peels)
• Microneedling with the MicroPen EVO (Health Canada approved device)
• Laser hair removal using the InMode Diolaze XL (full body and individual areas)
• LED light therapy (red and blue)
• Professional teeth whitening
• Medical-grade skincare product sales (Colorescience and other approved brands)
• Free skin consultations

Services are provided by Milena, a trained and experienced aesthetic practitioner. All treatments are performed in accordance with professional standards applicable in Ontario.

3. Use of the Website

3.1 Permitted Use

You may use the Site for lawful personal, non-commercial purposes only, including:

• Learning about our services and treatments
• Booking appointments and managing your bookings
• Purchasing products from our online shop
• Contacting us with inquiries

5.2 Pricing

• All prices are in Canadian dollars (CAD) and are inclusive of applicable taxes unless otherwise stated
• We reserve the right to change prices at any time without notice. Changes will not affect orders already confirmed
• In the event of a pricing error, we reserve the right to cancel affected orders and issue a full refund

5.3 Orders and Payment

• By placing an order, you represent that you are purchasing for personal, non-commercial use
• Orders are subject to availability and acceptance by us
• We accept payment via credit card, debit card, and other methods supported by our payment gateway
• Payment is processed at the time of order. You will receive an order confirmation email

5.4 Shipping and Delivery

• Products are shipped within Canada. International shipping is not currently available
• Shipping timelines are estimates and may be affected by carrier delays outside our control
• Title and risk of loss pass to you upon delivery to the carrier

By booking an appointment, you agree that:

• You will complete all required intake forms accurately and honestly prior to your treatment
• You will disclose all relevant medical history, medications, and skin conditions
• Failure to disclose relevant health information may affect the safety and outcome of your treatment
• We reserve the right to decline to perform a treatment if we believe it is unsafe or inappropriate for you
• Results of treatments vary by individual and are not guaranteed

7. Medical Disclaimer

IMPORTANT: Balanced Beauty Med Spa is an aesthetic practice, not a medical clinic or hospital. Milena is a trained aesthetic practitioner, not a licensed physician, dermatologist, or registered nurse.

The content on our website, including treatment descriptions, before-and-after photos, and educational articles, is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.

Nothing on this Site should be used as a substitute for professional medical advice from a licensed physician or dermatologist. Always consult your physician before beginning any new aesthetic treatment, particularly if you:

• Are pregnant or breastfeeding
• Have a chronic medical condition (diabetes, autoimmune disorders, blood disorders, etc.)
• Are taking prescription medications that affect skin sensitivity
• Have recently undergone surgery or a medical procedure
• Have a history of cold sores, active infections, or open wounds
• Have a known sensitivity to light, heat, or particular skincare ingredients
• Have received Botox, fillers, or other injectables within the past 2-4 weeks

8. Limitation of Liability

8.1 Exclusion of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BALANCED BEAUTY MED SPA, ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO:

• Your use of or inability to use the Site
• Any reliance on content published on the Site
• Any treatment received at our clinic
• Any product purchased from our online shop
• Unauthorized access to or alteration of your data
• Any other matter relating to our services

8.2 Cap on Liability

Our total aggregate liability to you for all claims arising from or relating to these Terms or your use of the Site or our services shall not exceed the greater of (a) the total amount paid by you to Balanced Beauty Med Spa in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

8.3 Exceptions

Nothing in these Terms limits or excludes liability for gross negligence, fraud, willful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Canadian law.

9. Disclaimer of Warranties

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12.2 Jurisdiction

You agree that any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto or the Regional Municipality of York.

12.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes within 30 days.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Booking, Cancellation & Refund Policy, constitute the entire agreement between you and Balanced Beauty Med Spa with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.
